Welcome to Spark Stack.

These Terms of Service (“Terms”) govern your access to and use of SparkStack.com and the products and services offered by Spark Stack Inc. (“Spark Stack,” “we,” “us,” or “our”).

Spark Stack Inc. operates this website and store.

Our ecommerce store is powered by Shopify, which provides technology that enables us to offer products and Services to you.

By accessing SparkStack.com, purchasing products, creating an account, or otherwise using our Services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use the Services.

Section 1 — Access and Accounts

You represent that you are at least the age of majority in your jurisdiction or have any legally required authorization to use the Services.

When using the Services, you agree to provide accurate, complete, and current information.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and all activity occurring through your account.

Section 2 — Our Products

We make reasonable efforts to accurately display and describe Spark Stack products.

However, product appearance may vary based on screen settings, lighting, photography, manufacturing tolerances, materials, and product revisions.

Product descriptions, specifications, designs, availability, and pricing may change without notice.

We may discontinue products or limit quantities where permitted by law.

Section 3 — Orders

When you place an order, you are making an offer to purchase products from Spark Stack Inc.

We reserve the right to accept, reject, limit, or cancel orders where reasonably necessary, including because of:

  • Product availability

  • Payment problems

  • Suspected fraud

  • Pricing errors

  • Listing errors

  • Inventory limitations

  • Violations of these Terms

Please review your order carefully before submitting it.

If you need to change or cancel an order, contact support@sparkstack.com as soon as possible.

We cannot guarantee that an order can be changed or canceled once it has entered processing or fulfillment.

Returns and refunds are governed by our Return & Refund Policy.

Section 4 — Prices and Billing

Prices, promotions, and discounts are subject to change before an order is placed.

The price charged will generally be the price displayed during checkout and reflected in your order confirmation.

Unless otherwise stated, prices may not include shipping, taxes, duties, customs charges, or other government-imposed fees.

You agree to provide accurate billing and payment information and represent that you are authorized to use the payment method submitted.

Section 5 — Shipping and Delivery

Shipping and delivery information is governed by our Shipping Policy.

Delivery dates and transit times are estimates unless expressly guaranteed.

Spark Stack Inc. is not responsible for delays caused by circumstances outside our reasonable control.

Section 6 — Returns and Refunds

Eligible products may be returned within 30 days of delivery in accordance with our Return & Refund Policy.

Section 7 — Intellectual Property

Unless otherwise indicated, Spark Stack Inc. owns or licenses the intellectual property associated with the Services, including Spark Stack branding, logos, product designs, website designs, graphics, photography, video, copy, software, product names, marketing materials, trademarks, and trade dress.

You may use the Services for personal, non-commercial purposes.

You may not reproduce, distribute, modify, republish, commercially exploit, scrape, reverse engineer, or otherwise use our protected materials without authorization except where permitted by law.

Section 8 — Optional Tools

We may provide access to third-party tools or services.

Your use of third-party tools may be governed by the applicable third party's terms and policies.

Spark Stack Inc. is not responsible for third-party tools outside our reasonable control.

Section 9 — Third-Party Links

Our Services may include links to third-party websites.

We are not responsible for third-party content, products, privacy practices, security, or transactions conducted with third parties.

Section 10 — Relationship With Shopify

Spark Stack Inc.'s store is powered by Shopify.

However, purchases made through SparkStack.com are transactions directly between you and Spark Stack Inc.

Shopify provides the ecommerce technology supporting our store but is not the seller of Spark Stack products.

Section 11 — Privacy

Our collection and processing of personal information is governed by our Privacy Policy.

Shopify also collects and processes certain information as the ecommerce platform supporting our Services.

Section 12 — Reviews, Feedback, and Submissions

If you voluntarily submit reviews, suggestions, ideas, comments, feedback, testimonials, or proposals, you grant Spark Stack Inc. a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, distribute, and display that submission for legitimate business and promotional purposes.

You represent that you have the right to provide the submission and that it does not violate another person's rights.

Section 13 — Errors and Inaccuracies

Occasionally, information on SparkStack.com may contain typographical errors, pricing errors, incorrect availability, incorrect shipping information, or other inaccuracies.

We reserve the right to correct errors and update information.

Where permitted by law, we may cancel an order affected by a material error.

If payment has already been collected for an order we cancel, we will refund the applicable amount.

Section 14 — Prohibited Uses

You may not use the Services:

  • For unlawful purposes

  • To violate applicable laws

  • To infringe intellectual-property rights

  • To harass or harm others

  • To impersonate another person

  • To submit fraudulent information

  • To transmit malware

  • To interfere with website security

  • To commit fraud

We may suspend or terminate access for violations of these Terms.

Section 15 — Termination

We may suspend or terminate access to the Services if we reasonably determine that you have violated these Terms, engaged in fraudulent or illegal activity, created security risks, or otherwise misused the Services.

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis except for warranties expressly provided by Spark Stack Inc.

Nothing in these Terms eliminates warranties or consumer rights that cannot legally be excluded.

To the fullest extent permitted by applicable law, Spark Stack Inc., its directors, officers, employees, affiliates, contractors, service providers, suppliers, and licensors will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising out of or relating to the Services or products.

Nothing in these Terms limits liability where limitation would be prohibited by applicable law.

Section 18 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Spark Stack Inc. and its officers, directors, employees, affiliates, contractors, suppliers, and service providers from third-party claims or reasonable expenses arising from your breach of these Terms, violation of applicable law, infringement of another person's rights, or misuse of the Services.

Section 19 — Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

Section 20 — Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not constitute a waiver.

These Terms, together with policies incorporated by reference, constitute the agreement between you and Spark Stack Inc. concerning the Services.

Section 21 — Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent.

Spark Stack Inc. may assign its rights or obligations where permitted by law.

Section 22 — Governing Law

These Terms and any separate agreements through which Spark Stack Inc. provides Services will be governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.

Section 23 — Changes to These Terms

We may update these Terms periodically.

The current version will be posted on SparkStack.com with an updated revision date.
